Who this is for. NRIs selling Indian property, repatriating sale proceeds, or unsure which country may tax a given receipt.
What the session examines
A partner reads the papers before the call, so the time goes on the position rather than on the background. These are the checkpoints the session works through.
- Residential status for the year under section 6, and what it does to the receipt in question
- Capital gains on the Indian asset, indexation, and the exemptions actually available
- The DTAA article that applies, and whether a Tax Residency Certificate and Form 10F are needed
- Whether a lower or nil TDS certificate under section 197 is worth applying for, and the timeline
- The Form 15CA / 15CB route for the remittance, and the FEMA limits on it
What you leave with
A written note after the call setting out the position taken, the forms required, and the order to file them in. It is yours to act on, with or without the firm.
How it runs
- Book a slot and pay. The fee is taken at booking, which is what holds the time.
- Send the papers at least a day ahead. 45 minutes is not long enough to also read them on the call.
- The session itself, with a partner who has already read the file.
- The written note follows.
