Terms of use

What this site is, and is not

Short version: everything published here is general commentary written from decided cases, not advice on your facts, and reading it does not make you a client.

Last updated 2 October 2026

These terms apply to this website. They are not an engagement letter; the terms on which we act for a client are set out separately and in writing before any work begins.

Nothing here is advice on your matter

The practice notes, case analyses and practice-area pages on this site are general commentary. They are written from published judgments and the law as it stood when each piece was written, and they describe how tribunals and courts have approached a question in general.

They are not advice, and they are not a prediction about your assessment, your appeal or your return. An outcome under section 68, to take the subject of several of these notes, turns on what is on your record and what enquiry the assessing officer made — which is precisely what a general article cannot know. Two matters that look alike in a summary are routinely decided differently.

Do not act, or decide not to act, on the basis of anything on this site without taking advice on your own facts. If a date is running against you, take it quickly.

Reading this site does not make you a client

Nor does sending us an enquiry, nor does our replying to one.

We become your advisers when we have agreed a scope in writing and confirmed it, and not before. Until that happens, please do not send us anything you would not want in the hands of someone who is not yet acting for you, and understand that we may already be acting for someone on the other side of the matter you are writing about.

Advisory sessions

The sessions described on the advisory page are fixed in scope and length. What each one covers is set out on that page, and the written note that follows addresses the matter as it was put to us during the session.

A session is a session. It is not representation, it does not put us on the record, and it does not commit either of us to anything beyond it. Where a session shows that a mandate is needed, the mandate is scoped and priced in writing separately.

Where a fee is quoted, it is quoted before the slot is held and confirmed in writing.

The law moves

Tax law changes, and it changes retrospectively more often than anyone would like. A note that was right when it was written may not be right now. Each piece carries its date; treat it as a description of the position on that date and nothing more.

We correct what we find to be wrong, but we do not undertake to keep every page current.

Links to other sites

Judgments cited in our practice notes link to BharatTax, where the full text sits, and other pages link outward from time to time. We do not control those sites and we are not responsible for what is on them. A link is a citation, not an endorsement.

What is ours

The writing, structure and design of this site belong to us. You are welcome to read it, print it, and quote it with attribution and a link. Republishing a piece in full, or reproducing it as your own, is not permitted.

Limits

We take care over what we publish and we check the citations before a piece goes up. We do not warrant that the site is free of error or always available, and to the extent the law allows we are not liable for loss arising from reliance on general commentary, which is what this is. Nothing here limits any liability that cannot lawfully be limited — in particular, our responsibilities to a client under an engagement we have accepted.

Professional standing

Ajay Arun Mehta & Associates is a firm of Chartered Accountants in practice in Delhi, regulated by the Institute of Chartered Accountants of India and bound by its Code of Ethics.

This website is published for information. It is not an advertisement, an inducement or a solicitation of work, and it should not be read as a claim to be better than any other firm.

Nothing here is investment advice

We are not registered with the Securities and Exchange Board of India, as an investment adviser or as a research analyst.

Our capital markets work is the taxation and reporting side of it: capital gains on listed equity and mutual funds, futures and options as a business and the audit test that follows, reconciliation with the annual information statement, employer share plans, and the reporting of foreign holdings. Where we review a portfolio, we are reviewing consequences — concentration, holding periods, losses available to absorb a gain, and what a proposed change would cost after tax.

Nothing on this site, and nothing said in the course of an engagement, is a recommendation to buy, sell or hold any particular security, a price target, or a view on when to enter or leave a position. Any observation on a holding is incidental to the professional service we have been engaged for.

If you want a recommendation, take it from a SEBI-registered investment adviser or portfolio manager. We will work alongside yours on the tax and reporting consequences of what they advise.

Which law applies

These terms are governed by the laws of India, and the courts at Delhi have jurisdiction.
